…s recognised the value of Duress of circumstances. The newer version of the Criminal Code, determines that the defence would be used for murder and attempted murder. However the burden proof would be on the accused. This brings it in line with the proposals for the Duress of threats. According to clause 26 the defence would be allowed to D if he committed the crime in order save himself or another from death of serious injury.
